On November 16, 2009 Overstock.com, Inc. (the “Company”) issued a press release (i) regarding its filing of its Form 10-Q for the quarter ended September 30, 2009 and the unaudited, unreviewed financial statements included therein, and (ii) announcing the scheduling of a conference call to be held beginning at 5:00 p.m. eastern time on Wednesday November 18, 2009.  A copy of the press release, including information for accessing the conference call or a replay of the call, is included as Exhibit 99.1 to this Report on Form 8-K.
